General Terms and Conditions. Hotel industry

I. Scope of application, conclusion of contract

The Tourismusverband Region Hall-Wattens acts as an intermediary in the business relationship with a booking party. A contract is thus concluded between the booking party and the accommodation provider (BU). The following General Terms and Conditions apply to this contract in the version valid at the time of booking. Any reciprocal claims arising from this contract shall only be asserted against the direct contractual partner and without any liability or joint liability on the part of the Hall-Wattens Region Tourist Board. The Tourismusverband Region Hall-Wattens shall agree with the booking party that the Austrian Hotel Contract Terms and Conditions (ÖHVB) as of November 15, 2006 and the supplementary General Terms and Conditions listed here shall apply to the accommodation contract as well as to the mediation of the same.

II The section "Cancellations" in particular is excerpted from the ÖHVB:

F Up to a maximum of 3 months before the agreed arrival date of the booking party, both contracting parties, i.e. both the booking party and the BU, may unilaterally cancel the accommodation contract without paying a cancellation fee. The notice of cancellation must be received by the contracting party within the deadline.

F The accommodation contract can be terminated by the guest up to 1 month before the agreed date of arrival of the booking party with a corresponding cancellation fee. In this case too, the notice of cancellation must be received by the contracting party within the deadline. However, a cancellation fee of 40 percent of the package price must be paid.

F Cancellations up to 1 week before the day of arrival are subject to a cancellation fee of 70 percent and within the last week 90 percent of the package price.

The Tourismusverband Region Hall-Wattens will offer the booking party cancellation insurance for each booking. The premium shall be borne by the booking party.

III Supplementary General Terms and Conditions:

1. the contracting parties agree that the accommodation contract and the agency contract shall be governed by Austrian law.

2. no ancillary agreements have been made.

3. amendments and additions to this contract must be made in writing to be legally effective.

4. it is agreed that the district court of Windischgarsten shall have jurisdiction over any disputes arising from this legal transaction - including disputes regarding the existence of the legal transaction.

5. the place of performance for the services of the Hall-Wattens Region Tourism Association is the town of Hall.

(6) The accommodation provider expressly confirms that the Austrian Hotel Contract Terms and Conditions are legally effective for all mediations; in addition, the accommodation provider declares to be fully aware of the General Terms and Conditions, to have received them and to accept them in full for each mediation.

7. the Hall-Wattens Region Tourist Board processes personal and company-related data in compliance with the applicable data protection laws. The data received will only be collected, processed and used insofar as they are necessary for the establishment, organization or modification of the own and any brokered business relationships. The Tourismusverband Region Hall-Wattens is entitled to transmit this data to partners commissioned by the Tourismusverband Region Hall-Wattens, insofar as this is necessary to process reservation inquiries or bookings. If the guest has expressly agreed to this, the Hall-Wattens Region Tourist Board is also entitled to collect, process and use the data received from the guest for the purposes of advice, advertising, market research and the needs-based design of offers.

8. no liability is assumed for the accuracy of the content of the image material provided by the accommodation providers.
